General terms and conditions for ticket purchases

1. Purpose and scope

These general terms and conditions for the purchase of tickets (hereinafter, the «Terms») govern the purchase of tickets and the making of bookings for Oktoberfest Girona through the website oktoberfestgirona.com, as well as the terms applicable to its use. Completing a purchase means that the user has had access to these Terms before purchasing and accepts their content.

The applicable Terms will be those in force at the time the purchase is made.

2. Organiser

Oktoberfest Girona is an event organised by BLOOM SPORT & ENTERTAINMENT, SLU, tax ID B21734017, with its registered office at Carrer de l'Avellana, 6, 17178 Les Preses (Girona), Spain (hereinafter, the «Organiser»).

For any query about ticket purchases or these Terms, the user may contact the Organiser at info@bloomprodu.com.

3. Information before purchase

Before completing the purchase, the user will have access to the information about the selected ticket or booking, including, as applicable, the date of the event, the number of attendees, the services included, the price and any particular conditions that apply.

It is the user's responsibility to check that the details and the option selected are correct before confirming the purchase.

4. Purchase process

Tickets and bookings are purchased through the process provided on the website.

The user must select the relevant ticket or booking, provide the required details and pay using one of the available methods. Before confirming the purchase, the user can review the information provided and correct any errors.

The contract is formed once payment has been authorised and the user receives the corresponding purchase confirmation at the email address provided during the process.

The purchase confirmation and the ticket, QR code, booking reference or equivalent document constitute proof of the contract.

5. Price and payment

The price of tickets and bookings will be the one shown on the website at the time of purchase. Before confirming it, the user will be informed of the total price, including legally applicable taxes and, where relevant, booking fees or any other additional cost. Payment is made using the methods available on the website at any given time.

6. Tickets

Tickets are valid only for the date, type and conditions stated on them.

The user is responsible for keeping the ticket safe and for not providing copies or reproductions to third parties.

Where tickets include a QR code, booking reference or equivalent identification system, this is unique. Once the ticket has been validated at the entrance, it cannot be used again.

If several copies of the same ticket exist, only the first one correctly validated will be valid, without prejudice to any action that may apply in the event of fraudulent use.

7. Table booking

Where the option purchased includes a table booking, the booking is tied to the date shown on the purchase confirmation.

The table is held until 19:30 on the relevant day.

If, by that time, no one linked to the booking has arrived, or if all the people at the table later leave and it becomes effectively free, the Organiser may consider the booking ended and assign the table to other attendees.

Losing the table booking through failure to arrive within the stated time does not give the right to a full or partial refund of the amount paid.

Losing the table booking does not in itself mean losing the right of access to the event granted by the tickets purchased, provided those tickets remain valid and the applicable access conditions are met.

8. Changes, refunds and right of withdrawal

Tickets and bookings purchased are final and, once the purchase has been completed, no changes or refunds will be accepted for reasons attributable to the buyer, without prejudice to cases where they are legally required.

Under article 103.l) of the consolidated text of the Spanish General Act for the Defence of Consumers and Users, the right of withdrawal does not apply to leisure services where the contract provides for a specific date or period of performance. Consequently, buying a ticket or booking for a specific date of Oktoberfest Girona is not subject to the general fourteen-day right of withdrawal that applies to certain distance contracts.

Being unable to attend the event because of the personal circumstances of the buyer or the attendees, including errors in the date selected or other circumstances not attributable to the Organiser, does not give the right to a refund of the amount paid.

9. Cancellation, suspension or change of the event

The Organiser may make justified changes to the timings, the programme, the layout of the spaces, the services or other aspects of the event where organisational, technical, safety, force majeure or other justifying circumstances arise.

Changes that do not substantially alter the essential conditions of the event do not in themselves give rise to a right to a refund.

If the event is definitively cancelled, the Organiser will inform buyers through the channels it considers appropriate and will, where legally required, refund the amounts paid in accordance with the applicable legislation.

In the event of suspension, postponement or any other substantial change, buyers will be informed of the applicable conditions and of the rights available to them under the legislation in force.

10. Access to and presence at the venue

Access to and presence at Oktoberfest Girona are subject to compliance with these Terms, with the event's access and operating rules, and with the applicable legislation.

The Organiser may take the measures necessary to ensure safety, the proper running of the event and good order among attendees.

Access may be refused, or a person may be required to leave the venue, in legally permissible cases, where that person:

  • Presents a fake, altered or duplicated ticket, or one that has already been validated.
  • Behaves violently, intimidatingly or in a discriminatory way, or seriously disturbs public order.
  • Puts their own safety or that of others at risk.
  • Fails to comply with safety rules or with the instructions of authorised staff.
  • Brings in objects or substances not permitted under the event's access rules.

Where refusal of access or removal follows a breach attributable to the attendee, no right to a refund of the ticket price arises.

11. Minors

Access for people under the age of majority is subject to the legislation in force and to the specific access conditions set by the Organiser.

The Organiser may require official identification to be shown where necessary to verify an attendee's age.

Alcoholic drinks will under no circumstances be sold or served to people under the legal age.

12. Liability

Attendees must make proper use of the facilities and show respect for the event staff, other attendees and the safety and conduct rules.

Each attendee is responsible for their personal belongings. The Organiser is not liable for loss, theft or damage not directly attributable to it.

The limitations of liability set out in these Terms do not in any case affect the rights granted to consumers and users on a mandatory basis by the applicable legislation.

13. Personal data protection

The personal data provided during the purchase process will be processed by the Organiser in order to manage the contract, the payment, the issuing and validation of tickets, access to the event and, where applicable, any issues relating to the purchase.

Full information about the processing of personal data, the legal bases, the recipients, the retention periods and how to exercise the corresponding rights is available in the website's privacy policy.

Accepting commercial communications, where required, is separate from accepting these Terms and is not a requirement for making a purchase.

15. Changes to these Terms

The Organiser may amend these Terms where necessary to adapt them to regulatory or operational changes or to changes in how the event runs.

Amendments will not affect purchases already completed, to which the terms in force at the time of purchase will apply, unless a legal provision states otherwise.

16. Applicable law and jurisdiction

These Terms are governed by Spanish law.

Any dispute arising from their interpretation or application will be submitted to the courts that are competent under the applicable legislation.

Where the user is a consumer, the rights and rules on territorial jurisdiction granted to them by the legislation in force will be respected in all cases.
